Terms of Service
These terms are a contract between you and Viterbi ("we", "us"). By creating an account or using the site, you agree to them. If you do not agree, do not use Viterbi.
What Viterbi is
Viterbi is an educational tool for backtesting and analyzing trading strategies. It exists to help you reason about strategies with honest statistics. It is not an investment advisory service, a brokerage, or a trading platform. Nothing on Viterbi is financial advice. The Risk Disclaimer is part of these terms.
Who can use it
You must be at least 18 years old and legally able to enter a contract. If you are using Viterbi on behalf of an organization, you confirm you have authority to bind it to these terms.
Your account
Give us accurate information and keep your sign-in credentials private. You are responsible for activity under your account. Tell us at [CONTACT_EMAIL] if you believe your account has been compromised.
Your content
You keep ownership of files you upload, including strategy CSV files. You give us permission to store and process them for one purpose: operating Viterbi for you, such as running the analyses you request and showing your data back to you. We do not sell your content and we do not use it to train machine learning models.
Viterbi is not a system of record. Keep your own copies of anything you upload. Do not rely on Viterbi as your only storage for any file that matters to you.
Acceptable use
- Do not use Viterbi to break the law.
- Do not attempt to gain unauthorized access to accounts, systems, or data.
- Do not upload files designed to damage or overload the service.
- Do not scrape the service or resell access to it.
- Do not present Viterbi's outputs to others as guarantees of investment performance.
Plans and payment
Viterbi has a free plan and a paid plan. Current prices, currencies, and what each plan includes are shown on our pricing page, which forms part of these terms.
Payments are processed by Stripe. We do not receive or store your full card number. Your use of Stripe's checkout is also subject to Stripe's own terms and privacy policy.
A paid plan renews automatically at the end of each billing period, at the price then listed for your plan, until you cancel. You can cancel at any time from your account or by emailing [CONTACT_EMAIL]. Cancelling stops future renewals; it does not refund the period you are currently in, and you keep paid access until that period ends, after which your account moves to the free plan.
If we change prices, we will give you notice before the change applies to your renewals, and you can cancel before it takes effect rather than accept it.
If a payment fails and is not resolved, we may downgrade your account to the free plan. Taxes may be added where required by law.
Refunds and cancellation rights
If Viterbi is materially broken for you and we cannot fix it, email [CONTACT_EMAIL] and we will work something out, including a refund where that is the fair answer. Outside that, paid periods are generally non-refundable, except where the law of your country says otherwise.
If you are a consumer in the European Economic Area or the United Kingdom, you normally have 14 days to withdraw from a purchase of digital services. By starting a paid plan and getting immediate access, you ask us to begin that service right away and you acknowledge that you lose the right to withdraw once the service has been fully performed. Nothing here removes consumer rights you have under the law where you live.
Not financial advice
Viterbi does not provide investment, legal, accounting, or tax advice. We are not registered as an investment adviser or dealer with any securities regulator in any jurisdiction. Backtest results are hypothetical and have real limitations, which the Risk Disclaimer explains. Decisions you make with real money are yours alone. If you need advice, talk to a licensed professional.
Our content
The Viterbi name, site design, text, visualizations, and software are ours or our licensors'. You may not copy or redistribute them except as the service itself allows.
Third-party services
Sign-in with Google is provided by Google and subject to Google's own terms and privacy policy. Payments are handled by Stripe. We host on infrastructure providers described in the Privacy Policy.
Changes to the service, and termination
Viterbi is in active development. Features may change, break, or be removed. If we remove something central to a paid plan, or discontinue the service, we will refund the unused portion of any period you have already paid for. We may suspend or terminate accounts that violate these terms. You can stop using Viterbi at any time and can request deletion of your account and data as described in the Privacy Policy.
We may modify these terms. If we make material changes, we will update the date above and post the new terms here. Continuing to use Viterbi after changes take effect means you accept them.
Disclaimers
Viterbi is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that results are correct, that data is preserved, or that the service is uninterrupted or secure.
Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or trading losses, arising from your use of Viterbi. To the maximum extent permitted by law, our total liability for all claims is limited to the greater of CAD $50 and the amount you paid us in the twelve months before the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. Courts located in Alberta have exclusive jurisdiction over disputes, and you and we each consent to that jurisdiction. If you are a consumer, this does not take away the protection of the mandatory laws of the country where you live.
